This Week's Short-Term Rental Regulation Updates

October 21-27, 2026: Airbnb Regulations

Executive Summary

New Haven, Connecticut moved closer to banning short-term rentals outside a host's own home, as a committee voted 5-2 to send the ordinance to the full Board of Alders next month. Existing Airbnbs would not be grandfathered, and platforms would have to check for a license before every booking. The Texas Supreme Court will hear Dallas's appeal on December 3 over rules that would push STRs out of single-family neighborhoods, which a lower court has kept on hold. Hoboken, New Jersey has no STR rules today, but the mayor plans an ordinance with a 60-day yearly cap and a ban on rent-controlled units. Augusta, Georgia's zoning rewrite would ban STRs in regular neighborhoods, though the city attorney expects homeowners renting 14 days or less, like during Masters Week, to stay exempt. Pacific, Missouri limited new STRs to downtown, and New Buffalo Township, Michigan paused new rentals for a year.

New Regulations

Pacific, Missouri

Zoning / Permitting · Published October 23, 2026

Pacific's Board of Aldermen voted 4-2 on October 20 to pass Bill 5332, which removes short-term vacation rentals as a conditional use in the NU Nonurban district and every residential zoning district, leaving them allowed only in the downtown C-1 district. According to the city administrator's memo, when a rental approved under a conditional use permit changes hands, the next owner cannot apply for a new permit.

New Buffalo Township, Michigan

Moratorium · Published October 26, 2026

New Buffalo Township's Board of Trustees voted October 26 to approve a one-year moratorium on new short-term rentals while it decides how to respond to resident complaints, with trustees aiming to add STRs to the township zoning ordinance, which doesn't address them today. Supervisor Michelle Heit said the township's STR ordinance from around 2018 helped, but new rentals are clustering in residential neighborhoods, including homes torn down and rebuilt to sleep as many as 14 guests, and a town hall on next steps is set for November 9.

Developing Regulations

New Haven, Connecticut

Licensing / Primary Residence · Published October 23, 2026

New Haven's Board of Alders Legislation Committee voted 5-2, at an October 22 hearing that ran past midnight, to advance an ordinance that would license rentals under 30 days and bar anyone from operating an STR outside their own primary residence, defined as the unit they live in, so owners of multi-family homes could not rent out apartments they don't occupy. Licensed units would be capped at 10 people and two adults per room, platforms would have to verify a license before completing a booking, existing Airbnbs would not be grandfathered, and the full Board of Alders is expected to vote next month in a city where Airbnb shows 911 active weekend rentals.

Dallas, Texas

Legal / Zoning · Published October 23, 2026

The Texas Supreme Court agreed on October 23 to hear the City of Dallas's appeal in its fight with short-term rental operators, setting oral arguments for December 3. The City Council approved rules more than three years ago that would push STRs out of single-family neighborhoods while still allowing them in commercial and multifamily areas, but a lower court sided with operators and paused enforcement, and city officials say the freeze has made it harder to register operators and collect hotel occupancy taxes.

Hoboken, New Jersey

Registration / Caps · Published October 19, 2026

Hoboken Mayor Emily Jabbour said she will introduce the city's first short-term rental ordinance after an October 18 aggravated assault outside a Garden Street basement unit listed on Airbnb, noting Hoboken has no STR regulations today. Jabbour said the ordinance would bar rent-controlled units from short-term rental use and set a 60-day annual limit, along with new safety standards and more accountability for property owners.

Augusta, Georgia

Zoning / Permitting · Published October 20, 2026

Augusta's draft zoning rewrite, the city's first full overhaul since 1963, would ban short-term rentals from regular residential neighborhoods and allow them with a permit only on agricultural land, in medical zones and in three downtown pockets, with hosts required to register, pay the 8% hotel-motel tax, cap occupancy at two adults per bedroom and six unrelated people, and provide one parking space per bedroom. Masters Week rentals dominated an October 21 public hearing, and the city attorney said the final draft is expected to keep the federal 14-day rule so homeowners renting 14 days or fewer would not need a permit or pay the tax, though the STR section won't be final until a Planning Commission presentation after the November meeting.

Clark County, Nevada

Licensing / Zoning · Published October 20, 2026

Clark County commissioners introduced ordinance amendments on October 20 that would end the license application lottery, set a 45-day review period for applications, and drop provisions barring licenses for anyone with past fines or court violations, following this month's Ninth Circuit ruling on the injunction against the county's rules. The Greater Las Vegas Short-Term Rental Association backed those changes but opposed moving distance rules into the county zoning code and classifying STRs as a conditional commercial use, and a public hearing and possible vote are set for November 3.

Breckenridge, Colorado

Legal / Fees · Published October 20, 2026

The Colorado Supreme Court agreed on October 19 to hear a rental owner's challenge to Breckenridge's $756-per-bedroom fee on licensed short-term rentals, which the town adopted in 2021 after a study tied STR guest spending to local jobs that don't pay enough to afford housing in town. The owner argues the fee is really a tax that needed voter approval under Colorado's Taxpayer's Bill of Rights because rentals already generate sales and lodging taxes, while a trial court and, in March 2026, the Court of Appeals sided with the town.

Fresno County, California

Tax / Ballot Measure · Published October 19, 2026

Fresno County voters will decide Measure A on November 3, a 12% transient occupancy tax on hotels, short-term rentals like Airbnbs, and RV parks in unincorporated areas of the county, which is one of three California counties with no such tax today. The tax is paid by guests, is projected to raise about $4.5 million a year for the general fund, and would not apply on top of the 12% tax the cities of Fresno and Clovis already charge.

Carrboro, North Carolina

Permitting / General · Published October 20, 2026

Carrboro's Town Council put its short-term rental rules on its October 20 agenda after neighbors objected to a developer's plan to build three rental homes on Alabama Avenue, which already have zoning and building permits but still need special use permits to operate as STRs. Council members can't directly stop the project but were set to discuss whether changes to the town's STR rules or other legal options could address neighbors' concerns.
